Kenya Undertakes Stakeholder Consultations on Accession to the Malabo Convention

The Government of Kenya, through the Office of the Data Protection Commissioner (ODPC), has initiated broad stakeholder consultations following the Cabinet’s approval of Kenya’s accession to the African Union Convention on Cyber Security and Personal Data Protection, commonly referred to as the Malabo Convention.

The Malabo Convention is a landmark African Union treaty that provides a comprehensive framework on cybersecurity, electronic transactions, and personal data protection across the continent. Its accession is a significant step towards strengthening Kenya’s role in advancing a safer, more secure, and trusted digital environment.

As the statutory body mandated to regulate the processing of personal data, safeguard individuals’ privacy, and enforce compliance with the Data Protection Act, 2019, the ODPC is leading national consultations to ensure that stakeholders across all sectors have the opportunity to contribute to this important process.

Call for Written Submissions

To promote inclusivity, the ODPC has convened consultative virtual meetings with a wide range of groups including Ministries, Departments and Agencies (MDAs), County Governments, the Private Sector, Academia, Civil Society, Professional Bodies, the Media, and the general public. Beyond the scheduled meetings, members of the public are also encouraged to submit written comments and inputs to the ODPC.

Building a Trusted Digital Future

The consultations will provide an opportunity to unpack the role of stakeholders and the public in shaping Kenya’s pathway to acceding to the Malabo Convention. By gathering views from diverse actors, Kenya aims to ensure that its approach reflects both national priorities and continental aspirations.

In accordance with Article 10 (2) of the Constitution, stakeholders and members of the public are hereby invited to submit their comments, proposals and recommendations through written memoranda on the Regulations, Regulatory Impact Assessment and the Data Sharing code in the following format: –
